Please read these Terms & Conditions carefully and in their entirety before using www.howellhealthandwellness.comand www.howellhealthsolutions.org (hereinafter referred to as the “Site”). The Site and its content are owned by Margaret Howell, Registered Nurse, PLLC.

PURPOSE: These Terms & Conditions clearly explain, outline, and lay out the rules and conditions for using, viewing, and browsing the Site, as well as purchasing or downloading any course, program, service, or product offered by us on the Site.

ARBITRATION NOTICE: These Terms & Conditions contain a mandatory Arbitration Clause in Section 18. By agreeing to these terms, you agree to resolve disputes through binding arbitration and voluntarily waive your right to a jury trial.

“Company”, “We”, “I”, “Our”, or “Us” means Margaret Howell, Registered Nurse, PLLC, www.howellhealthandwellness.com, and www.howellhealthsolutions.org.
“Content” means any written, visual, video, or audio information contained on the Site, including emails received from Margaret Howell or Margaret Howell, Registered Nurse, PLLC, and downloadable materials (e.g., blog posts, graphics, newsletters, documents, templates, guides).

“Site, Courses, Services, and/or Products” means www.howellhealthandwellness.com, www.howellhealthsolutions.org, Content, email newsletters, social media posts, blog posts, Remote RN Health Consultations, Wound Care services, Manual Lymphatic Drainage (MLD) services, Remote Caregiver Mentoring, courses, guides, eBooks, forms, worksheets, webinars, and templates available on the Site.
“Site” means www.howellhealthandwellness.com and www.howellhealthsolutions.org, including all associated pages, landing pages, forms, or sub-pages.
“You” or “Your” means the user, customer, client, or viewer of the Site.

2. Consent

By using the Site or making any Purchase, you implicitly and voluntarily agree to abide by these Terms & Conditions, our Privacy Policy, and our Disclaimer.

You represent and warrant that you are at least 18 years of age. Any use of or access to the Site and its Content by anyone under age 18 is unauthorized and in violation of these Terms & Conditions.

3. Site Rules & Zero-Tolerance Policy

By using the Site or purchasing services/products, you agree and consent not to:

Abuse, intimidate, threat, or harass any person on or through the Site or during service delivery.
Post or transmit obscene, offensive, libelous, defamatory, or abusive content, or content that infringes our intellectual property rights or those of others.
Use the Site for any purpose that violates federal, state, or local laws of the United States or New York State.
Post or transmit unwanted, unsolicited commercial communications (“spam”).
Post copyrighted materials, photographs, or media that do not belong to you.
Promote or sell unauthorized third-party products, services, or content through the Site.
Copy, download, share, post, or transmit our intellectual property in a manner that infringes upon our legal rights.

Zero-Tolerance Policy for Violence & Abuse: Margaret Howell, Registered Nurse, PLLC maintains a strict zero-tolerance policy for violence, threats, physical or verbal abuse, sexual harassment, offensive language, discrimination, or intimidation directed toward Margaret Howell, RN, or any affiliated staff, contractors, or clients. Any such conduct will result in the immediate termination of care/services and revocation of site and portal access without refund. If necessary, incidents will be reported to appropriate law enforcement authorities.

4. Registered Nursing Scope & Disclaimer

Margaret Howell is a Registered Nurse (RN) licensed in the State of New York, and Margaret Howell, Registered Nurse, PLLC is a fully insured business entity.

Educational vs. Clinical Relationship: Browsing this Site, reading Content, or purchasing downloadable digital products does NOT establish a formal Nurse-Patient relationship. A formal clinical relationship is established only upon executing a signed Written Service Agreement / Informed Consent form and completing our intake process.
Scope of Practice: Services provided by a Registered Nurse in NYS include nursing assessment, care coordination, health education, supportive mentoring, and clinical care (such as Wound Care and Manual Lymphatic Drainage) within the legal scope of RN practice. Services and Content do NOT constitute the practice of medicine, medical diagnosis, or prescribing of medications.
Physician Consultation: Content and educational recommendations are not substitutes for diagnosis, medical treatment, or evaluation by a primary care physician, Nurse Practitioner (NP), or Physician Assistant (PA). Always consult your physician before making changes to your medical treatment, medications, diet, or exercise regimen.

5. Consent to Terms

By browsing this Site, booking a consultation, or purchasing digital products, you voluntarily agree to these Terms & Conditions as stated herein.

6. Changes to Terms & Conditions

We reserve the right to amend or alter these Terms & Conditions at any time without prior notice. When updates occur, we will revise the “Updated On” date at the bottom of this page. Continued use of the Site following changes constitutes acceptance of the modified terms.

7. External & Third-Party Links

The Site may contain links to third-party websites or external resources for information and convenience. We do not endorse, guarantee, or assume liability for the accuracy, content, or privacy practices of external websites. Accessing third-party sites is done at your own risk.

8. Intellectual Property Ownership

(Private medical intake information and PHI are managed securely under our Privacy Policy and HIPAA practices).

11. Access & Account Security

You agree to maintain the confidentiality of any passwords or client portal login credentials created for purchases or remote services (e.g., via Practice Better). You are responsible for all actions taken under your credentials and agree to notify us immediately at margaret@howellhealthsolutions.org of any suspected security breach.

12. Content Sharing Guidelines

You may share public links to our Site for personal, non-commercial purposes, provided clear credit and direct back-links to Margaret Howell, Registered Nurse, PLLC are maintained. Written permission via email (margaret@howellhealthsolutions.org) is required prior to using any Content or images for commercial purposes.

13. Testimonials & Client Results

Testimonials and client stories displayed on the Site represent individual experiences and are provided for illustrative purposes only. They do not constitute a guarantee or representation that future clients will achieve identical or similar health or caregiving outcomes.

You agree to release, discharge, and hold harmless Margaret Howell, Registered Nurse, PLLC, its members, officers, contractors, and affiliates from any and all claims, demands, damages, actions, or liabilities arising directly or indirectly out of your access to the Site or reliance upon Content and educational materials.

16. Errors & Omissions

Healthcare practices, nursing guidance, and regulations evolve rapidly. While reasonable efforts are made to ensure content accuracy, we do not guarantee that all information on the Site is free from errors or completely current. You are encouraged to verify health information with your primary healthcare provider.

17. Refund, Cancellation & Missed Appointment Policy

Cancellations & Missed Appointments: Scheduled appointments represent dedicated professional time set aside exclusively for you. Cancellations or rescheduling requests made with less than 24 hours' advance notice, as well as missed appointments (no-shows), will be charged the full rate for the scheduled service.
Services Rendered: Due to the custom, professional nature of Remote RN Health Consultations, Wound Care visits, Manual Lymphatic Drainage, and Remote Caregiver Mentoring, payments for services already rendered are non-refundable.
Digital Purchases: Downloadable digital tools, e-books, and digital templates are non-refundable once delivered.

18. Mandatory Binding Arbitration

In the event of a dispute or claim arising out of your use of the Site, Services, or these Terms & Conditions, you agree to first contact us directly at margaret@howellhealthsolutions.org to attempt an informal resolution.

If the dispute cannot be resolved informally, you agree that any remaining dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its commercial rules.

Waiver of Jury Trial: You voluntarily waive your right to a trial by jury or court trial.
Venue: Any arbitration hearing shall take place within 50 miles of Ontario, NY.
Limitation of Award: The sole monetary remedy available to you in arbitration shall be limited to a refund of payments made to Margaret Howell, Registered Nurse, PLLC for the specific service or product in dispute. You agree not to seek consequential, exemplary, or punitive damages.

19. Governing Law

These Terms & Conditions and any disputes arising under them shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to conflicts of law principles.

20. Consent to Jurisdiction

You irrevocably consent to the exclusive jurisdiction and venue of the state courts located in the State of New York or the United States District Court for the Western District of New York for any legal proceeding arising out of these Terms & Conditions or your use of our Services.

21. Service of Process

You irrevocably agree that service of process in any legal matter may be executed in accordance with the laws of the State of New York and waive any objections regarding service under NYS law.

22. Payment Terms & Chargeback Policy

Payment Authorization: By submitting credit card or payment details, you authorize Margaret Howell, Registered Nurse, PLLC (and secure processors, such as Practice Better) to charge your payment method for chosen services, subscriptions, late cancellation fees, or digital products.
Payment Plans: If an installment payment plan is elected, you authorize automatic recurring charges on agreed-upon due dates until the balance is paid in full.
Declined Payments: In the event of a declined charge, access to services or course portals may be suspended until payment is brought current. You remain responsible for all contractual balances.
Chargebacks: Fraudulent chargeback requests or unnotified chargeback threats are strictly prohibited. In cases of unauthorized chargebacks, we reserve the right to report the unpaid account balance to collection services and credit reporting agencies.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Margaret Howell, Registered Nurse, PLLC and Margaret Howell shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of your use or inability to use the Site, Content, or Services. Your sole and exclusive remedy for any breach or claim shall be limited to the total dollar amount paid by you for the specific product or service at issue.

24. Defense & Indemnification

You agree to defend, indemnify, and hold harmless Margaret Howell, Registered Nurse, PLLC, Margaret Howell, and our members, officers, contractors, and agents from and against all losses, damages, liabilities, costs, and attorney's fees arising out of: (a) your breach of these Terms & Conditions or Privacy Policy; (b) your misuse of the Site or Content; or (c) any violation of applicable laws or third-party rights.

25. Termination of Access

We reserve the right, in our sole discretion, to terminate or restrict your access to the Site, client portal, or services at any time without prior notice if you violate these Terms & Conditions, misuse content, engage in abusive or threatening conduct, or breach any other agreement with us.

26. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Margaret Howell, Registered Nurse, PLLC regarding the use of the Site and Services, superseding all prior oral or written communications.

27. Severability

If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
